It appears that Brewster Academy violated the FAA rules for commercial use which "The agency bars commercial use of drones no matter how seemingly benign". Here's a story about the FAA coming down on a baseball team for basically doing exactly what Brewster Academy did which was film some video from a drone to promote their business. Here's the article:

I have a GoPro camera and have ordered a pocket drone. Since I want to create some videos for this site is it commercial use and prohibited? The rules seem to be very muddy right now.

Default Drone tours of Lake Winnipesaukee

We are looking forward to viewing our fantastic lake as viewed from a drone [a drone's-eye view].
