Default Boat race RSA's ?

I was having a discussion with a friend about boat race events. I'm under the impresson that you need a permit to organize a race. He said not on the lakes, just on the rivers.

Do any of our scolars have a link to the correct statute?

Oh gosh I HOPE New Hampshire has some sort of laws/guidelines on boat races. I can't imagine not having to have a permit to race dozens of boats at high speeds across the lake. It will be interesing to see the answer to this.

Here's the administrative rules required to hold the event you are talking about on the Lake. If you look closely at the expiration dates it appears that as posted most of these rules have expired. However, the State's website is known to not have timely updates, and a disclaimer within confirms that. Best bet is to call Director Barrett direct at MP Headquarters in Gilford to get the official scoop......

PART Saf-C 413 WATER EVENT AND SLALOM COURSE PERMITS



Saf-C 413.01 Permits, When Necessary.



(a) Pursuant to RSA 270-D:4, any individual who undertakes the following activities shall obtain a permit from the commissioner:



(1) Waterski slalom;



(2) Waterski jump;



(3) Fishing tournament or derby;



(4) Waterski show;



(5) Boat races;



(6) Boat parade;



(7) Parasailing; or



(8) Other water event.



(b) Permit applications shall be obtained by writing or calling the department of safety, division of safety services, office of the director, 31 Dock Road, Gilford, NH 03249-7627, (603) 293-0091.

Saf-C 413.02 Water Event or Slalom Course Permit Application.



(a) An individual wishing to conduct a water event or slalom course shall provide the commissioner with the following:



(1) The applicant's name;



(2) His or her date of birth;



(3) His or her address;



(4) His or her telephone number;



(5) The type of water event;



(6) The name of water event, if applicable;



(7) The name of public water on which water event will be located;



(8) The name of town or city where public water is located;



(9) The dates the water event will be held;



(10) The starting and ending time of water event each day;



(11) A brief description of the water event;



(12) The number of participants in the water event;



(13) A map or sketch of the water event area including the direction "north" as a reference; and



(14) Signature of applicant and the date.

Saf-C 413.03 Submission of Permit Applications.



(a) After completion, permit applications shall be mailed or hand-delivered to the director, division of safety services, 31 Dock Road, Gilford, New Hampshire 03249-7627.



(b) Incomplete applications shall be returned to the applicant. The applicant may resubmit the permit application once completed.

Saf-C 413.04 Permit Application Approval.



(a) Upon receiving a permit application, the commissioner shall consider each application in light of the following factors:



(1) The size of the public water;



(2) Boating traffic volume;



(3) Type(s) of boating permitted on the public water;



(4) Depth of the public water;



(5) Any underwater obstacles which present dangers to participants in the water event;



(6) Swim areas, rafts and beaches located near the proposed water event;



(7) Any speed or horsepower restrictions on the public water;



(8) Any restrictions listed under Saf-C 402 through Saf-C 408 involving the ecology or environment of the public water; and



(9) Accident statistics for the public water, if any.



(b) After considering the factors under paragraph (a), the commissioner shall approve or deny the permit.



(c) Upon approval of a permit application, the commissioner shall return the permit application with the date and his signature to the applicant.

Saf-C 413.05 Permit Application Denial.



(a) If a permit application is denied by the commissioner, he shall advise the applicant, in writing, of the nature of the denial.

I can tell you first hand that the Alton Canoe Race back in June required Dept of Safety OK (permit), having the race course on the Merrymeeting River and also on Lake Winni to the Alton Boat docks.
