I know this is a late comment since we're past the refund filing period but thought I'd comment anyway; maybe folks will remember it come filing time next year!
Page 2 of the Gas Tax Refund Form (RT-123) clearly states in column 1 "**Type of Equipment" and below that column is an explanation of the double asterisk (**). It states, "BOAT, SNOWMOBILE, ATV, OHRV, PWC - ONLY". My interpretation of that statement is lawn and garden equipment are excluded, at least on this form.
Perhaps there's a different form for the landscaping/lawn maintenance outfits that use a lot of gas?
