Where this whole thing went south is that the replacement of the boat house is NOT "in kind" yet was approved. Arguing the building height after the fact was never really going to go anywhere.

That's what the zoning board approval was for, re-siting the building 10 foot back from where the existing structure was. That was approved and where the TOWN noted a height restriction upon approval...
