We're in Tuftonboro and would like to extend our 30 ft dock to 40 ft. We were told by a vender of dock systems that the state of NH allows docks to be up to 40 ft long. What is the process involved? Do we need paper work from the state and/or town to extend and existing dock by 10 ft.?

If it's a seasonal dock, I think you can have a 6' x 40' dock without special permission. Seasonal docks do not need an advanced permit I believe, only what's called a Permit by Notification which means you can st it all up and then notify the State after the fact. Not sure if you still need to get a building permit from your local town prior though.

The standard size for a seasonal pier on Winnipesaukee is 6 ft x 40 ft. If there are no existing docking structures on the frontage, you have at least 75 ft of frontage, stay 20 ft away from the property lines and don't need to alter the shoreline to install it, you can use the Seasonal Dock Notification Form provided by NH DES at the website Feb linked to. This is different than the Permit By Notification Form (PBN). The PBN requires a $100 fee the Seasonal Dock Notification requires no fee. If your current dock is seasonal file the notification before you install it this year. Acknowledge that it "existed but has been removed and abandoned" on the notification form. If you have a permanent dock or multiple docks any modification you want to make should be applied for using a Standard Dredge and Fill Application.

At no time is it appropriate to complete work in the bank or water and then notify or apply to the NH DES after the fact. :eek:

Does the 40 ft. rule apply to both permanent and seasonal docks?

40 ft. is seasonal only. Permanent docks are limited to 30'.
