What is the status of these floating toys? Are they treated like swim rafts? Do they need a permit? If yes, what kind of permit and how do I get one?

And, if my beach and access point belongs to an Association, do I need their permission to put one in the water? (After all, they don't own the lake).

I'm pretty sure swim rafts don't need a permit, there was talk about it a year ago but it never happened.

You should check with your association but they do not have jurisdication on the waters as you stated.

Regulating State/Public Waters
Most bodies of water over 10-acres in size are considered "public waters" within the State of NH and fall under the jurisdiction of the Dept of Safety -- Division of Safety Services AND the Dept of Environmental Services -- Water Quality Division. Property owners with frontage on such bodies of water own up to the waterline, they do NOT own the land underneath the water (contrary to the popularly held belief they do). Moorings, docks and rafts are permitted (and likewise restricted) by the State of NH. They have the task of trying to balance the rights of property owners with those of the general public. It certainly is not an enviable job.

If your beach access is through an association I would check with them for permission or advice. There is no reg about putting one in, but you could have an insurance issue if someone else uses it and gets hurt.

I'm pretty sure you need to own shoreline to put one in..... maybe some of our more legal eagles will chime in.

Property owners have certain littoral rights that others do not. Like the right to install docks and moorings (with proper permits) and to have rafts. I don't think being a member of an association that owns waterfront property gives you those rights.
