Fishing without a license question
Assume I'm boating with a friend who wants to fish. He has no license.
I drive the boat. He fishes. I have no fishing license either. The fishing cops stop us. My friend is obviously in violation of the law. Am I ? |

They will watch with binoculars, if you touch the pole you are fishing. Pretty much impossible to fight.

x10 with what jrc said.. They will know the answer to anything they ask you. If they come to your boat..equals.. they have been watching you for the last 15 minutes.

And if you are trolling, you very well may be in violation too, as the operator involved in a fishing operation. First question in my mind was that given the relatively inexpensive cost of a short term license, why are we even having this discussion? Tell your friend "no license, no fishing from my boat. " I doubt you would lose a friend over this, and if you did, then you wouldn't have been losing much of a friend. Oh, and I have told my adult son "no license, no fishing". Good luck with your decision, I hope it is the "right" one.

I'd aslo think that as the operator of the boat, you'd be responsable for everyone on your boat obeying the law. Not sure, but one would think.

Tell your friend to buy the darn license, otherwise, if you guys get caught, all the fishing gear will be confiscated, (true), and your boat will be impounded, (don't know, but sounds nice and threatening to someone looking to avoid paying for a fishing license )
PS: if you friend is under 16, he does not need a license to fish. |

We got stopped trolling with two lines in the water......I have a license and my friend didn't.
I showed my license and he didn't question it since I'm allowed two lines |

....curiosity?
So how much does the fishing violation cost? Anyone know? And, how much does it cost if one gets caught with an unregistered boat......like a ten foot rowboat that now has a little electric trolling motor? What's the price, and does it go onto one's car driving record and effect one's insurance rates?
Just being curious here???

bottom line is "buy a fishing license". If your friend is fishing off your boat, tell him "I will let it slide this time but next time you are on my boat and want to fish...please have a fishing license or I will ask you not to fish." That is about as polite as it gets. By the way, I think even you starting your motor to move your friend to a different spot to fish would be considered assisting him/her in fishing if a Conservation Officer thought you needed the point to be made more forcefully.
If he/she only wants to fish a day or two all summer...they have 1 and 3 day licenses for about the same money as a days worth of bait. |

The child catches something and cries for some help. Some adult comes to see what's up and grabs the pole, perhaps the kid hooked the bottom or has a tangle, or perhaps the child even hooks a fish. Now the adult is fishing without a license and all equipment and boat can be confiscated, fines levied, etc? All because a child wanted a little fun? I don't fish, so I don't know the laws. Can a child under 16 fish without a license at all times, or only with the supervision of an adult that has his own license?

No license is a $93. fine. The F&G like to say "consider it a 'donation' to maintaining the lake".

fishing tales
First of all SAL said HE was driving the boat. He never said He was fishing.
Then we go to binoculars?? I suppose Nh Police use them too, waiting for people to leave a bar?? Then you can't help a kid snagged!! Maybe if the kid falls in and drowns, the NH law requires the undertaker to pay the fishing fine for you. |

Maybe there should be a VIEW TAX when you use binoculars.
Could the binocs give me a fine because a passenger changed into a bathing suit in my boat;(indecent exposure)? I don't remember about the fishing license responsibility being on the boat owner at my Boating safety class. I guess the next time someone gives me a car ride anywhere, the DMV should want me to see their drivers license. |

I have also never heard of anyone getting a fine for helping a child fish. Any officer who would give a ticket for that would be a heartless fool. Every fish and game officer I have run into has been courteous, and professional. Tell your buddy to get a license and enjoy your day without worries.. Dan

This is where I heard about the F&G watching before ticketing, I thought I remembered binoculars but they actually filmed them.

I was wacked three years ago, because I was stupid and said first day of the year wanted to get out on the lake(stupid move). Myself, and two cousins on the boat, my cousins boat. All three of us were wacked, thy did observe us from a distance, and once all three had lines in the water they came over. It was stupid of us, and I now have the license. We were respectful and they were to, we took our fines, felt stupid and continued the day because they said we could. We also catch and release though, nothing was confiscated and we have nothing on the boat. I am sure they could do that if you had fish in the well, and you were being a jerk, I am sure they could take everything

Only the people that have been witnessed with holding a line in the water are deemed to be fishing, if trolling it is the owner of the boat and those operating it

I am 70, have camp on Bear and stay six months each season but am a resident of Georgia. Wonder if I qualify for free permanent license.

I have fished winni (all over the world too) for nearly 50 years, I have never been cited for any infraction, nor have I ever broken any fish and game laws and have never stolen any of the "kings fish" but I am tired of being treated as GUILTY by the green jackets that check us every yr. generally while ice fishing! I will never give them the time of day !
Several years ago while standing on the ice during derby weekend four or five green jackets screamed up to our bob-house on sno mobiles as we stood around, they asked if we had caught any then got around to asking for fishing licenses, my buddy had on a jumpsuit and had big handful of peanuts in the shell in his hand, he struggled with the zipper and handed the co the p nuts while he fished out his license, while all were watching he stopped and said with a grin how he'd have a good story on Monday morning about how the game warden had his nuts in his hand over the weekend! Even the other green jackets had a rare smile on their faces as we fell down laughing! |
