Question Mooring question, can my neighbor's mooring be in front of my dock?

Hi everyone
I love this board and have found great info here, but this is my first post. I hope I'm in the right area. I'm in Alton Bay and have tried to be a good neighbor, but I've been pushed too far! My neighbor has his mooring right on his property line and recently replaced his chain with a longer one so now his boat is constantly in front of my dock. In addition he has a dock that he doesn't use except for company. He also has another mooring that's empty. I think he's trying to keep his waterfrontage open for swimming, but I feel like his boat shouldn't be in front of my dock. Does anyone know the rules for mooring placement? I've talked to him about it but he just ignores me so now I'm done being nice

Default Based on my understanding . . .

if they are blocking your dock you may have some leverage. If they're not blocking your access it's going to be hard to fight.

How does a property owner get approval for a mooring?
The individual or group needs to show there is a demonstrated need, such as no other docking facilities for their boat(s).

ATTENTION ALL LOT OWNERS WITH LESS THAN FIFTY (50) FEET OF FRONTAGE:
RSA 270:59 VIII(b) requires that lot owners with less than 50 feet of frontage must obtain written consent of the abutting property owners stating that the abutting property may be included in the frontage calculation.
Such consent shall be signed by both parties, notarized and filed with the mooring application.

Default he cannot

his mooring cannot be at the property line(pretty sure set back is 20 feet of the line that would run out to water) nor can his boat swing out over that.

You need to go to MP and look at where his permit says the mooring should be and then ask MP to enforce. Very easy and painless with MP. GOOD LUCK with the guy next door.

corkydesigner, While I was browsing I just noticed that you are fairly new to posting on the forum after joining back in October 2012. We are glad that you have come aboard and joined us. Have fun and enjoy the Winni Forum while making many new friends.

Thanks for your post regarding what you believe is a navigational problem to your pier caused by a neighbors mooring buoy. I am sure you will get the straight skinny on what is right and what's wrong from the member's.

Is a permit required for every mooring on every lake or just the lakes listed on the link provided in the earlier post ?

I have been through the process before.

Lucky for me the poor guy who was infringing on my spaces had his boat move along with mooring into my breakwater...causing his boat a lot of damage and me none....after that he was more inclined to move it far away from me. LOL

My parent's had that same issue with a dock. The next door neighbors put it right on the property line so that the boat was always in front of my parent's property. My mother wrote a letter but somehow they got the dock. Whether the guys lied or what, I don't know.

Wink It Could Be Worse...

A year after I'd scouted some winter properties, I went back to the second most-wanted property on my list. It had 60' of frontage.

That particular area had superb potential—indeed, in just a year—it had been developed into a large new community of "proper" homes. Having already purchased another property 50 miles away, I wanted to see if I'd be affected by "buyer's remorse".

As it turned out, that "neighbor" (to the right) had put in a new dock. My intended lot purchase was to the left in the photo.

Maybe that "neighbor" bought the land that you wanted. Is that possible?

Does your "winter" home location have rules about where a dock can be put?
